Bras N Things Rewards “May 2011 Promotion”
HOW TO ENTER
To be eligible to enter the draw, individuals who are members of the Bras N Things Rewards Program, dusk Rewards Program or Pulse Rewards Program must present their Bras N Things Rewards card, dusk Rewards card or Pulse Rewards card at the point of sale when they make a qualifying purchase at any Bras N Things store between 9 May 2011 and 9 June 2011. A qualifying purchase is defined as a purchase of $5.00 (AUD for Australian residents and NZD for New Zealand Residents) or more for existing and newly enrolled Bras N Things Rewards members.
With each qualifying purchase made, the entrant will receive a voucher containing a unique code. To enter the draw, entrants must visit www.brasnthingsrewards.com, follow the prompts to the competition entry page, input all requested details including the unique code found on the voucher and submit the fully completed entry form by 5:30pm AEST on 9 June 2011.
TERMS AND CONDITIONS
1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2. Entry is only open to Australian and New Zealand residents aged 15 years or older who are members of Bras N Things Rewards, dusk Rewards or Pulse Rewards. Employees (and their immediate families) of the Promoter, participating retailers and agencies associated with this promotion are ineligible to enter.
3. Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to all terms and conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to this promotion.
4. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
5. Multiple entries permitted, subject to the following: (a) only one (1) entry permitted per qualifying purchase; (b) each entry must be submitted separately and in accordance with entry requirements; (c) only one (1) unique code per entry is permitted; (d) the same unique code cannot be used more than once; and (e) unrecognised codes will be deemed invalid. Incomplete or indecipherable entries will be deemed invalid.
6. Promotion commences on 9 May 2011. Final entries must be received by 5.30pm AEST on 9 June 2011. The draw will take place at Visible Results Australia Pty Ltd, 2C Hayes Rd Rosebery NSW 2018 on 20 June 2011 at 12pm AEST. Draw winners will be notified by phone and in writing via email within two (2) business days of the draw. Winner will also have their name published in The Australian on 27 June 2011. The Promoter’s decision is final and no correspondence will be entered into.
7. The first valid entry drawn will win a holiday for two (2) adults in Las Vegas, USA, valued at up to AUD$9,399, depending on date and point of departure. Prize consists of return economy flights for two (2) people from the winner's nearest Australian or New Zealand capital city to Las Vegas, USA. Prize also includes six (6) nights’ accommodation for two (2) people at the Bellagio Hotel. Additional expenses, including taxes (excluding airline and airport taxes), airport transfers, meals, insurance, in-room charges, all other ancillary costs, any optional tours or activities, tips and items of a personal nature, are not included. Travel is subject to availability at time of booking. Travel is not available during school holidays or peak holiday periods such as Christmas or Easter. Booking is subject to availability and some black out periods may apply. Travel must be completed by 9 June 2012.
8. Frequent flyer points will not form part of the prize. Prize is subject to the standard terms and conditions of individual prize and service providers. Winner may be required to present credit card at time of accommodation check in.
9. If the winner is under the age of 18 years, the prize will be awarded to the winner's nominated parent or guardian on the winner’s behalf.
10. If for any reason a winner does not take the prize, or an element of the prize, by the time stipulated by the Promoter, then the prize, or that element of the prize, will be forfeited.
11. If the prize (or any part of the prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
12. Total prize pool is up to AUD$9,399. Prizes, or any unused portion of a prize, is not transferable or exchangeable and cannot be taken as cash
13. A draw for the prize, if unclaimed, may take place on 17 October 2011 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winner, if any, will be notified by phone and in writing via email within two (2) business days of the draw and their name will be published in The Australian on 24 October 2011.
14. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
15. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
16. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
17. Nothing in these Terms and Conditions limit, exclude or modify or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia and New Zealand (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

Except for any liability that cannot be excluded by law, including the Non-Excludable Guarantees, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of, or participation in, the prize.
19. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, agents, contractors, service providers, prize suppliers and as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period unless otherwise advised, use the information for promotional, marketing, research, profiling and publicity purposes including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
